City Mart Local is a local listing, advertising, discovery and connection platform operated from Washington State, USA.
These Terms of Use explain how City Mart Local works, what you agree to when you use it, and the limits of City Mart Local's role in transactions between users. Please read them before creating an account.
City Mart Local helps people in the same area post listings, discover what is nearby, and contact one another. Listings may include items for sale, free items, services, jobs, trades, advertisements, businesses and events.
City Mart Local provides the platform. The people who post and respond to listings are independent users who deal with each other directly.
By creating an account or using City Mart Local, you agree to these Terms of Use together with the Marketplace Rules, the Prohibited Items & Activities Policy, the Safety Guidelines and the Privacy Policy. Those documents are incorporated into these Terms by reference.
Acceptance is given by affirmative action during registration: checking each required box and selecting "I Agree & Create Account." City Mart Local records which document versions you accepted and when.
City Mart Local is currently available only to users who are 18 years of age or older.
During registration you must provide your date of birth and separately confirm that you are at least 18. If the date of birth you provide indicates you are under 18, an account will not be created.
You may not use another person's account, and you may not create an account for someone who is not eligible.
You agree to provide accurate registration information, including a valid email address and your correct date of birth, and to keep your account information current.
One person should maintain one account unless City Mart Local expressly permits otherwise. Accounts are personal to you and may not be sold or transferred.
You are responsible for keeping your password confidential and for activity that occurs under your account. Use a password you do not reuse elsewhere.
City Mart Local never asks for your password or authentication codes. Notify City Mart Local promptly if you believe your account has been accessed without authorization.
Your username and public profile are visible to other users. Choose a username that does not impersonate another person, business or brand and that complies with the Marketplace Rules.
Your date of birth, email address, phone number and postal code are not displayed on your public profile.
City Mart Local may reclaim or require a change to a username that is misleading, infringing, abusive or otherwise in violation of these Terms.
City Mart Local provides listing, advertising, discovery, search and connection functionality. It is a venue that connects users.
City Mart Local is not the buyer, the seller, the employer, the service provider, an agent, a broker, an auctioneer, an insurer or a guarantor in any transaction between users.
City Mart Local does not take possession of listed items, does not inspect or authenticate items, and does not arrange shipping, delivery or fulfillment between users.
Listings are created by users. You are solely responsible for the content, accuracy and legality of listings you publish, including photos, titles, descriptions, prices, categories and contact preferences.
Eligible listings are displayed for the applicable listing period. Listings may be removed, restricted, rejected, suspended or allowed to expire in accordance with these Terms, the Marketplace Rules, the Prohibited Items & Activities Policy and City Mart Local's moderation practices.
You are responsible for independently evaluating listings, users and proposed transactions before acting on them, including:
City Mart Local charges its own platform fees for publishing listings. The current standard listing model is a $1.99 posting fee for a standard 7-day listing.
The posting fee is paid by you to City Mart Local. It pays City Mart Local for publishing and displaying an eligible listing and for supporting operation of the platform. Posting fees also help discourage spam, bots, mass low-quality posting and duplicate or junk listings.
The posting fee is not a verification fee, an authentication fee, a buyer protection fee or an insurance fee. Paying a posting fee does not mean City Mart Local has verified the seller or the buyer, authenticated or inspected an item, guaranteed or insured a transaction, or endorsed any listing or user.
Paying a posting fee does not create a right to publish content that is unlawful or that violates City Mart Local's policies. Listings that violate those policies may be rejected or removed.
City Mart Local uses a third-party payment processor, currently Stripe, to process its own fees. Card details are handled by that processor, not stored by City Mart Local.
You agree to pay the fee shown before you complete a payment, plus any applicable taxes. Payment records associated with your account are retained for accounting, support, fraud-prevention and legal purposes.
If a listing is not published because it fails moderation or eligibility requirements, contact City Mart Local through the support options in My Mart so the payment can be reviewed.
Transactions are entered into directly between users. Buyers and sellers communicate and arrange payment, pickup, delivery, meetups, trades, service arrangements and all other transaction details between themselves.
City Mart Local is not a party to those arrangements, does not supervise them, and is not present when users meet.
City Mart Local does not collect, hold, transfer, escrow or distribute money exchanged between users. There is no cart, checkout, buyer payment processing, seller payout, escrow, shipping or order fulfillment between users.
Because City Mart Local never handles user-to-user money, it cannot reverse, refund or guarantee a payment between users. Fees paid to City Mart Local are entirely separate from money exchanged between users.
By publishing a listing you represent that you have the lawful right to offer the item or service, that the listing is accurate to the best of your knowledge, and that the listing complies with applicable law and City Mart Local's policies.
City Mart Local does not guarantee that any listing is accurate, complete, legal, safe, authentic, available or suitable for a particular purpose.
The Prohibited Items & Activities Policy describes categories of goods, services and conduct that may not be listed or facilitated through City Mart Local. That policy is part of these Terms.
Attempting to use City Mart Local to facilitate unlawful activity is prohibited, whether or not the specific item or activity is named in the policy.
The Marketplace Rules describe expected behavior, listing standards and communication standards. Violations may lead to listing removal, feature restrictions, suspension or account termination.
City Mart Local provides contact actions so users can reach one another using only the contact methods the recipient has enabled. Messages sent through City Mart Local may be stored for security, moderation, abuse-prevention and support purposes.
You are responsible for what you send. Harassment, threats, spam, scam attempts and other abusive communications are prohibited.
If you choose to share your phone number, email address, address or other personal details directly with another user, you do so voluntarily and at your discretion.
City Mart Local uses city-level location to organize listings and improve local relevance. Your city may be displayed publicly in connection with your listings.
Your postal code, when provided, is kept private and is used to improve location relevance and future nearby functionality. City Mart Local does not request or display your street address, exact home location or precise GPS coordinates.
Where review functionality is available, reviews must reflect a genuine experience and must not be traded, incentivized, manipulated or written about yourself.
You are responsible for all content you submit, including listings, photos, messages and reviews, and you must have the rights necessary to submit it.
City Mart Local's name, branding, design, software and content are owned by City Mart Local or its licensors and may not be copied, scraped, reproduced or used commercially without permission.
You must not post content that infringes another party's copyright, trademark, publicity or other rights. City Mart Local may remove content reported as infringing and may terminate accounts of repeat infringers.
You keep ownership of the content you submit. You grant City Mart Local a non-exclusive, worldwide, royalty-free license to host, store, reproduce, adapt for display formats, publish and distribute that content for the purpose of operating, promoting and improving City Mart Local.
This license ends for future public display when you delete the content or your account, except for copies retained in backups, moderation records or where retention is required for legal or security purposes.
City Mart Local uses automated and manual moderation to review listings, photos and text for policy violations and safety risks. Automated systems may flag, hold or reject content.
Moderation is not a guarantee that content is lawful, accurate or safe, and City Mart Local does not undertake to review every item of content or every user interaction.
City Mart Local may remove, hide, restrict, refuse or unpublish a listing that violates law or City Mart Local's policies, that appears fraudulent or unsafe, that is duplicated or spammed, or that presents an unacceptable risk to the platform or its users.
Removal of a listing does not entitle you to compensation beyond any remedy required by applicable law.
City Mart Local may restrict features, suspend or terminate an account for violations of these Terms or its policies, for suspected fraud or abuse, for conduct that endangers other users, or where required by law.
You may stop using City Mart Local at any time and may request account deletion from My Mart.
You may not use City Mart Local to defraud, deceive or exploit other users, to send unsolicited commercial messages, to operate bots or scripted posting, to create fake accounts, or to circumvent moderation, rate limits, blocks or enforcement actions.
If you believe you have encountered a scam or an unsafe user, report it through the reporting tools and, where appropriate, contact local authorities.
City Mart Local relies on third-party providers for hosting, database, email delivery, geographic data, content moderation and payment processing. Those providers operate under their own terms and privacy practices.
City Mart Local is not responsible for third-party websites, services or content that you access through links or through interactions with other users.
You are responsible for determining and meeting your own tax, licensing, permitting, reporting and registration obligations arising from your activity, including sales of goods and provision of services.
City Mart Local does not provide legal, tax or accounting advice and does not determine which obligations apply to your circumstances.
The Safety Guidelines describe practical precautions for meeting and transacting locally. Following them can reduce risk but does not eliminate it.
You decide whether and how to interact with other users, and you are responsible for exercising appropriate caution when doing so.
To the maximum extent permitted by applicable law, City Mart Local is provided "as is" and "as available," without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.
City Mart Local does not warrant that the service will be uninterrupted or error-free, or that listings, users or transactions will meet your expectations. Nothing in this section limits rights that cannot be limited under applicable law, including certain consumer-protection rights.
To the maximum extent permitted by applicable law, and except where prohibited by applicable law, City Mart Local is not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data or lost opportunities, arising out of your use of the service or your dealings with other users.
To the maximum extent permitted by applicable law, City Mart Local's total liability for any claim relating to the service is limited to the greater of the amount of City Mart Local fees you paid in the twelve months before the claim arose, or one hundred United States dollars.
Some jurisdictions do not allow certain limitations or exclusions of liability. Where that is the case, these limitations apply only to the extent permitted, and nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for fraud, willful misconduct, or death or personal injury caused by negligence where such exclusion is prohibited.
To the extent permitted by applicable law, you agree to indemnify and hold harmless City Mart Local from third-party claims, damages, losses and reasonable expenses arising from your content, your listings, your transactions with other users, or your violation of these Terms or applicable law.
This obligation does not apply to the extent a claim arises from City Mart Local's own conduct, and it does not apply where such indemnity is prohibited or unenforceable under applicable law.
If you have a concern about City Mart Local, contact City Mart Local first through the support options in My Mart. Most issues can be resolved informally, and City Mart Local will make reasonable efforts to respond and work toward a resolution.
City Mart Local does not currently require binding arbitration, and there is no class-action waiver or jury-trial waiver in effect. Nothing in these Terms asks you to waive rights that applicable law does not allow you to waive, and nothing here prevents you from contacting a consumer-protection agency or seeking relief available to you by law.
Disputes between users are between those users. City Mart Local is generally not responsible for investigating, mediating or resolving them, and it cannot refund money it never handled, though you may report policy violations for review.
If this section is updated in the future — for example to add a dispute-resolution procedure — the change will be published as a new document version with an effective date.
City Mart Local is operated from Washington State, USA. These Terms are intended to be governed by the laws of the State of Washington, without regard to its conflict-of-law rules.
Where mandatory consumer-protection or other laws of your place of residence apply, those laws continue to apply to you.
City Mart Local may update these Terms. Each version carries a version number and effective date, and prior versions are retained together with the record of what you accepted.
When a change is material, City Mart Local will provide notice through the service or by email and may ask you to accept the new version before continuing to use affected features.
These Terms remain in effect while you use City Mart Local. Either you or City Mart Local may end the relationship as described above.
Sections that by their nature should survive termination — including content licenses for retained records, disclaimers, limitations of liability, indemnification and governing law — continue to apply after your account ends.
